Welcome to FlareSeek. Please read and understand the terms of this Software License Agreement (the “Agreement”). Unless you accept these terms, you are not authorized to download, install, or use the software and related services. By installing, copying, downloading, accessing, or otherwise using this software, you agree to be bound by all terms of this Agreement. If you do not agree, do not install, copy, or use the software. This Agreement is a legal agreement between you and Dongguan Dongcheng Leishi Intelligent Application Software Studio (“Leishi Intelligent”) regarding your use of the FlareSeek software (“Software”).
1. Intellectual Property
The Software is developed by Leishi Intelligent or licensed by authorized rights holders (“Licensors”). All intellectual property and all content related to the Software, including but not limited to text, icons, graphics, images, charts, colors, UI design, layout, data, additional programs, AI models, printed materials, and electronic documents, are protected by copyright laws and international treaties. All such rights are owned by Leishi Intelligent and/or its Licensors.
2. License Scope
2.1 Download, Installation, and Use: You may download, install, and use the Software for non-commercial purposes in unlimited quantities.
2.2 Copying, Distribution, and Dissemination: You may copy, distribute, and disseminate the Software for non-commercial purposes in unlimited quantities. Each copy must remain complete and authentic, including all software files, documentation, copyrights, trademarks, and this Agreement.
3. Restrictions
3.1 Reverse Engineering: You may not reverse engineer, decompile, disassemble, or modify resources embedded in the Software, unless expressly permitted by applicable law.
3.2 Prohibited Actions: You may not, without authorization, use, copy, modify, link, reprint, compile, publish, mirror, or derive products or services from the Software’s graphics, text, or related information.
3.3 Component Separation: The Software is licensed as a single product and may not be separated for any purpose.
3.4 Separate Authorization: Any commercial sale, copying, or distribution (including resale, pre-installation, bundling, etc.) requires written authorization from Leishi Intelligent.
3.5 Reservation of Rights: All rights not expressly granted remain with Leishi Intelligent. Any other use requires written consent.
4. User Guidance
4.1 Product Scope: FlareSeek is a PC client software that provides local image search services.
4.2 Third-Party Content: Any files processed through the Software are provided by the user or their owners (“Third-Party Files”). The Software only performs image recognition on the original files and does not represent any endorsement or opinion. The Software makes no guarantees regarding legality, accuracy, authenticity, applicability, or security of Third-Party Files.
4.3 Local Processing: The image search function is performed locally. Images are not stored on the Software’s servers.
4.4 Prohibited Content: You may not use the Software to upload, read, download, copy, publish, distribute, or repost content that violates laws or regulations, including but not limited to:
4.4.1 Violating constitutional principles;
4.4.2 Endangering national security, disclosing state secrets, subverting state power, or undermining national unity;
4.4.3 Damaging national honor or interests;
4.4.4 Inciting ethnic hatred or discrimination or undermining ethnic unity;
4.4.5 Undermining religious policy, promoting cults or superstition;
4.4.6 Spreading rumors or disrupting social order;
4.4.7 Spreading pornography, gambling, violence, or inciting crime;
4.4.8 Insulting or defaming others or infringing legal rights;
4.4.9 Other prohibited content under laws or regulations.
4.5 Due Diligence: Before using Third-Party content (including images, audio, video, documents, links), you should verify its legality, accuracy, authenticity, usefulness, and security, including malware risks. If unsure, consult professionals.
4.6 Liability for Third-Party Content: The Software is not responsible for any damages arising from reliance on Third-Party content or services, including personal injury, property loss, reputational harm, or IP infringement. Any disputes should be resolved with the third-party content owners.
4.7 Membership Notice: Memberships can only be purchased in the Software app. Unauthorized resale is prohibited. Memberships are virtual services; once purchased, you may choose not to continue, but fees are not refundable unless the Software cannot provide the service.
5. Disclaimer and Limitation of Liability
5.1 Internet Risks: Internet services may be affected by user behavior, network quality, and other factors. Risks include harassment due to leaked information, malware from other software or websites, and related security threats. Users should protect personal information and use strong passwords.
5.2 Service Interruptions: Service may be interrupted due to force majeure, viruses, hacking, system instability, user shutdowns, or network issues. Users assume these risks. Leishi Intelligent provides no warranties for such interruptions.
5.3 Content Risks: Users acknowledge the risk of encountering offensive, illegal, or infringing content. Leishi Intelligent and partners provide no warranties, express or implied, including fitness, merchantability, title, or non-infringement, and are not liable for damages resulting from improper or illegal use.
5.4 Limitation of Liability: Leishi Intelligent shall not be liable for indirect, consequential, punitive, incidental, special, or criminal damages, including loss of profits, even if advised of the possibility. Total liability shall not exceed fees paid by the user during the membership period, if any.
5.5 No Liability in the following cases:
5.5.1 Providing personal information as required by law or government;
5.5.2 Third-party use of personal information under applicable service terms;
5.5.3 Temporary site closure due to hacking, viruses, or government control;
5.5.4 Force majeure events;
5.5.5 Other exempt circumstances described in service terms or statements.
6. Governing Law and Dispute Resolution
6.1 This Agreement is governed by the laws of the People’s Republic of China.
6.2 Any dispute arising from or related to this Agreement shall be resolved through friendly negotiation. If negotiation fails, either party may submit the dispute to the Dongguan Intermediate People’s Court.
7. Miscellaneous
7.1 If any provision is found invalid or unenforceable, it will be deemed removed, and the remaining provisions remain in force.
7.2 Leishi Intelligent may modify this Agreement at any time based on legal changes or business needs. The latest version will be published in new software releases. If you disagree, you may uninstall the Software. Continued use implies acceptance.
7.3 Leishi Intelligent reserves the right to interpret and amend this Agreement to the fullest extent permitted by law. For questions, contact us at fawu@ls-ai.cn.
